Channel Points (“Points”) are digital content that can be earned and redeemed by Twitch account holders on certain Twitch channels. Points are channel-specific, meaning they have to be earned and used on the same channel. Points earned on one channel cannot be redeemed on a different channel.**
Points cannot be earned on all channels. Twitch allows creators to decide whether viewers can earn Points on their channels, and if so, how. Creators are also permitted to decide how viewers can redeem Points on their channels, within the parameters set forth in this Channel Points Acceptable Use Policy (“Policy”). Points redemption opportunities may vary based on the geography of the creator or the users.
This Policy applies to any Twitch creator or user that offers, earns, obtains, interacts with, redeems, or otherwise uses Points. We may change this Policy from time to time. The most current version of this Policy will be posted on the Twitch website and will supersede all previous versions of this Policy. Any changes will be effective upon posting. We encourage you to review this Policy on a regular basis. If you continue to earn Points, redeem Points, or interact with Points in any other way after this Policy has been changed, you will be deemed to have read, understood and unconditionally consented to and agreed to such changes.
Your use of Points is further subject to and governed by Twitch’s Terms of Service, Twitch’s Terms of Sale, and Twitch’s Community Guidelines. If you are a developer, your use of Points in Extensions or other experiences is also subject to Twitch’s Developer Services Agreement. Any capitalized terms used in this Policy but not otherwise defined have the meaning given to them in the Terms of Service, Terms of Sale, or Community Guidelines, as applicable. In the event of a conflict or inconsistency between this Policy and those agreements, this Policy shall prevail, govern and control solely with respect to Points.
Points are not a money instrument
Points are digital content intended to be acquired and consumed on Twitch. Points have no monetary value (i.e., are not a cash account or equivalent), and do not constitute currency or property of any type.
Points cannot be purchased or exchanged outside of the Twitch Services
Points cannot be purchased. This Policy prohibits selling, trading, bartering or transferring Points (or offering to do those things) to other users of Twitch in exchange for money or real currencies. Twitch or creators can offer premiums or other benefits in exchange for Points, but Points cannot otherwise be exchanged for items that have value outside of the website available at http://www.twitch.tv, and its network of websites, software applications, or any other products or services offered by Twitch (the “Twitch Services”). Any Points used in activities that are prohibited by this Policy may be confiscated or cancelled
How to Earn Points
There are many ways to earn Points. Twitch defines the type of activities that earn Points in general on Twitch; creators decide whether to participate in some or all of these activities on their channels. For example, some creators may only have one or two ways to earn Points on their channels—or none at all—while others may have many different earning opportunities. Some of the ways users can earn Points may include the following (subject to change):
The number of Points you can earn for the above activities may vary by channel or time. Twitch reserves the right, in its sole discretion, to determine and modify, at any time, the number of Points that may be earned for any given activity. Users have no tangible or intangible property, proprietary, intellectual property, ownership, or monetary interest in Points, which remain Twitch digital content subject to the Twitch Terms of Service.
How to Redeem Points
As with earning opportunities, Points redemption opportunities will vary from channel to channel. Creators define how Points can be used on their channels within the parameters of this Policy and any other guidelines or rules issued by Twitch. Creators can announce unique redemption opportunities on their channels within the parameters of this Policy and any other guidelines or rules issued by Twitch. Twitch expects Creators to announce any limits on the redemption opportunities that they make available to users who visit or participate in their channel. Additional redemption opportunities may be made available through extensions or other third-party integrations, which may be subject to additional terms and conditions. Where applicable, Creators must provide notice to users of additional third-party terms and conditions along with a link to the additional terms. Because of differences in local laws and regulations, not all redemption opportunities will be available to all Twitch users; with respect to redemption opportunities offered by Twitch, any restrictions will be communicated at the time of redemption. As stated above, Twitch may offer some of these redemption opportunities for creators to use on their channels; others may be offered by the creator themselves or a third-party developer. In all cases, Twitch reserves the right to limit the type of redemption opportunities that are available. For example, Twitch may cancel a Points redemption opportunity that a channel planned to offer. Users, creators, and developers may not rely on a particular redemption opportunity or type of redemption opportunity continuing to be available, or continuing to be available for the previously offered number of Points. In other words, the number of Points required for any redemption opportunity may be substantially increased, any redemption opportunity may be withdrawn, and restrictions may be imposed on any redemption opportunity. Twitch may also impose a limit on the number of redemption opportunities in the aggregate or by type that may redeemed per user, per day, per channel or per any other criteria that may be selected by Twitch from time to time in its sole discretion.
Once a user has redeemed Points, the Points are gone and there are no refunds, returns or exchanges for additional Points, cash, or other goods and services, even if the redemption opportunity that your Points were redeemed toward is cancelled. To the extent permitted by law, users have no tangible or intangible property, proprietary, intellectual property, ownership, or monetary interest in digital content received through Points redemption opportunities, which remain Twitch digital content subject to the Twitch Terms of Service.
Points will expire if not used by a date specified by Twitch. Users may view current earned Points and their expiration date by logging onto their account.
Points should only be used in accordance with this Policy. In particular, be sure to follow this exemplary (but not exhaustive) list of guidelines:
Modification and Termination
Twitch may modify this Policy in whole or in part, including, but not limited to, how Points can be earned, how Points can be used, the type or “classes” of Points available, and the conditions under which Points may expire or be forfeited at any time, with or without notice, even though these changes may affect a user’s ability to use the Points that he/she has already earned. The Points program has no predetermined termination date and may continue until such time as Twitch decides to terminate the Points program. Twitch may, in its sole discretion, modify or terminate the Points program, in whole or in part, at any time and for any reason or no reason at all. If Twitch decides to terminate the Points program, notice of that decision may be posted on the Twitch website and/or via email to the user’s email address currently on file with Twitch. If Twitch decides in its sole discretion to discontinue Points, users will have approximately thirty (30) days or a different amount of time deemed reasonable by Twitch from the date Points termination is announced to use their remaining Points, subject to the availability of redemption opportunities. Twitch makes no representation or warranty about the number or type of redemption opportunities that may be available while the Points program is in effect or after it announces that the Points program is being terminated, and many redemption opportunities that may have been available prior to termination may quickly become depleted or otherwise unavailable once the Points program termination has been announced. Any Points remaining in a user’s account at the time of termination will be forfeited and no compensation will be provided.
Violations of this Policy
Twitch may terminate your license to use the Twitch Services, block or prevent your future access to and use of the Twitch Services, cancel accumulated Points, alter the number of Points in a user’s account or suspend the user’s membership privileges at any time with immediate effect if Twitch determines in its sole discretion that the user (a) has acted in a manner inconsistent with applicable laws or ordinances; (b) acted in a fraudulent or abusive manner; (c) breached this Policy; (d) engaged in any fraud or abuse concerning Points, Points usage or Points redemption; or (e) engaged in any conduct or act that causes Twitch to terminate or suspend the user’s access to Twitch. Twitch may also take appropriate administrative or legal action if any of the things listed above occurs. Nothing contained in this Policy shall limit Twitch in its exercise of any legal or equitable rights or remedies.
Any violations or attempted violations of this Policy by you (or any third party using your account or acting on your behalf) will constitute a violation of the Terms of Service, including this Policy, by you and a material breach of any other applicable agreement, and/or supplements to any applicable agreement(s), with Twitch.
Twitch’s failure to enforce this Policy in every instance in which it might apply does not amount to a waiver of Twitch’s rights to enforce this Policy under other similar or identical circumstances.
